نظم 101 : مباديء القانون
تعتبر هذه المادة من المتطلبات الأساسية للكلية بصفة عامه ولقسم الأنظمة بصفة خاصة وتعتمد على دراسة المبادئ العامة الأساسية للدراسات القانونية وينقسم منهج الدراسة إلى جزئين :
أولاً : نظرية القانون : وتشتمل على :-
التعريف بالقاعدة القانونية وبيان خصائصها ، التمييز بين قواعد القانون وقواعد الديــن وقواعد الأخلاق ، وتقسيمات القانون، مصادر القاعدة القانونية ، وتطبيق القانون ، إلغاء القاعدة القانونية وتفسير القانون.
ثانياً : نظرية الحق وتشمل على :-
التعريف بالحق ، تقسيمات الحقوق وأنواعها ، أركان الحق ، شخص الحق ، محل الحق ، الحماية القانونية للحق.
أ - شخص الحق: بداية الشخصية القانونية ونهايتها ، الحالة العائلية - القرابة - الاسم - الموطن - الأهلية .
ب - محل الحق : تقسيم الأشياء : عقار ومنقول - مثلية وقيمية .
ج - الحماية القانونية .
Principles of Law : BL 101
This subject matter is considered as an introductory to the studies of law, whereas its aims are to acquaint the students with the basic principles and rules of this subject matter , as well as, availing considerable details of such rules which are regulating the legal affairs , in particular to those rules of contract in comparison with Islamic concepts of Sheri’a .
The subject matter is divided into two parts : -
the first part :- compromises of the following matters :- analyzing the theory of law , as well as , the theory of right , in additional to studying the contents of rules of law and its characteristics , kinds and rules of sources , as well as the application of law’s interpretation and abrogation. finally , studying the theory of right from different spectrums .
The second part : - compromises of the following subjects , studying the obligations from the point of introduction to its kinds and its sources , as well as , studying the contract from the point of prevailing its pillars , and the correction of its conditions , its effects and its removals , as well as , the effects of obligations in general
