نظم 412 : العقود التجارية وعمليات البنوك متطلب سابق : نظم 314
يقصد بالعقود التجارية وعمليات البنوك تلك القواعد التي تحكم التعاقدات التي تتم بين التجار، والعلاقات بين البنوك وعملائها . وُتدرس تلك المادة في جزئن :
* يخصص الجزء الأول للعقود التجارية المختلفة والتي تتمثل في السمسرة والوكالة بالعمولة والنقل البري، وذلك من حيث شروط إبرام هذه العقود والآثار التي ترتبها بالنسبة لأطرافها .
* ُيدرس في الجزء الثاني عمليات البنوك - وخصوصا عقود الإيداع النقدي والصكوك - والتحويل المصرفي والحساب الجاري، والاعتمادين البسيط والمستندي، وخطابات الضمان. وتقوم الدراسة في هذا الجزء على ما استقرت عليه الأعراف المصرفية وما صدر عن مؤسسة النقد من قرارات وتعاميم، وذلك لعدم وجود نصوص تشريعية متكاملة تنظمها . كما أن دراسة هذا الجزء تشمل التركيب التنظيمي للبنوك في المملكة وفقاً لنظام مراقبة البنوك الصادر سنة 1396هـ .
BL 412 : Commercial Contracts & Banking Transactions Pre. Req. : BL 314
The aim of studying this subject matter is to introduce the student to the organizing framework of the banking system in the Kingdom and aspects of observation of the Monetary Agency in such field. He also be intimated by the whole banking transactions those dealing with the banks, as well as, some aspects of commercial contracts those are important in commercial life practices such as contracts of agency by commission, brokerage, land transportation and commercial distributorship (Agency).
This subject matter being taught in two parts : -
* The first part :- commercial contracts and compromise of contracts of brokerage, its definition and effects, contracts of commission agent, its definition and effects, contracts of commission agent, its definition, effects and execution, contracts of land carriage, its definition and effects.
*The second part :- banking transactions, and compromise of definition of the banking system and the directions of supervision over it, the important principles those governing banks through the performance of their tasks, the variable banking transactions such as opening of banking accounts, as well as, granting loans, letters of credit and issuing letters of guaranty and others.
